Where the water comes from is the whole distinction
A Land Subject to Inundation Overlay maps riverine flooding — a watercourse leaving its channel and spreading across the land beside it. You can usually see why it applies. A Special Building Overlay maps overland flow: stormwater moving across the surface when the drainage system is full and can take no more. That water follows the fall of the land, not a creek line, and its path can run down a street, between houses and through a back yard that has never been near a river. The SBO is the one people are surprised by, because nothing about the site suggests it.
What it changes on a project
Where an SBO applies, a permit is generally required for a building or works, and the assessment is about whether what you propose obstructs or redirects that flow — onto the neighbours, usually. In practice that reaches the floor level, the siting, fencing and even the landscaping, because a solid fence across a flow path is an obstruction as surely as a wall is. The referral goes to the drainage authority rather than being settled by the Shire alone, which adds a step and a timeframe. Establish whether the block carries one before a design is drawn, because the flow path is a fact about the land that a design has to accommodate rather than argue with.
